Welcome to Astromidnight.pt ("we," "us," or "our"). We provide stargazing and imaging processing services, workshops, and related products.

  • Acceptance of Terms: By booking a service, enrolling in a course, or purchasing a product from us (collectively, "the Services" and "the Products"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use our Services or purchase our Products.
  • Modification: We reserve the right to modify these Terms at any time. Your continued use of the Services or purchase of Products after any such changes constitutes your acceptance of the new Terms.

 

2. Description of Services and Products

 

We offer the following categories of goods and services:

  • Stargazing and Astrophotography Workshops (On-Site/Online): Guided sessions, tours, or workshops that are dependent on weather conditions for successful delivery.
  • Imaging Processing Courses (Online): Digital educational content, tutorials, or live online classes focused on image processing techniques.
  • Physical Products (e.g., Calendar): Tangible goods sold online and/or on-site.

 

3. Payment and Pricing

 

  • Pricing: All prices for Services and Products are listed on our website and are subject to change without notice. The price charged will be the price in effect at the time of placing the order or booking.
  • Payment: We accept credit card, PayPal. Payment must be received in full before access to a course, participation in a workshop, or shipment of a physical product is granted.

 

4. Refund and Cancellation Policy

 

Your right to a refund depends on the type of Service or Product purchased.

 

A. Stargazing and Astrophotography Workshops (Weather Dependent)

Workshops are subject to prevailing weather conditions.

  • Cancellation due to Unfavorable Weather: If we determine that the weather conditions (e.g., heavy cloud cover, rain, high winds, or severe atmospheric turbulence) make the workshop impossible or severely degrade the quality of the experience, we reserve the right to cancel the session.
    • In the event of a cancellation by us due to weather, you will be offered the choice of:
      1. A full refund of the workshop fee.
      2. Rescheduling the workshop for a mutually agreed-upon future date.
  • Customer Cancellations: Cancellations made by the customer are subject to the following rules:
    • Cancellations made less than 7 days before the event are non-refundable.
    • Failure to attend without prior notice (a "no-show") will result in the forfeiture of the entire fee.

 

B. Imaging Processing Courses (Online)

Due to the digital nature of these courses, which often provide immediate access to proprietary content, a strict no-refund policy is enforced.

  • No Refund Policy: All sales of online Imaging Processing Courses are final and non-refundable.
  • Faulty Access: If you experience technical issues preventing access, you must notify us immediately at [Your Support Email]. We will work to resolve the access issue. A refund will only be considered if we are unable to provide access to the purchased content within a reasonable time.

 

C. Physical Products

  • No Refund Policy: All sales of physical products, such as the Calendar, are final and non-refundable unless the item arrives damaged or defective.
  • Damaged/Defective Goods: If a product arrives damaged, you must notify us within 7 days of delivery, provide photographic evidence, and we will offer a replacement or a full refund upon verification.

 

5. Intellectual Property and Licensing

 

  • Course Content: All content provided in the Imaging Processing Courses (e.g., videos, PDFs, guides, templates, and course materials) is our exclusive property and is protected by copyright.
    • You are granted a limited, non-exclusive, non-transferable license to use the course material for your personal, non-commercial educational purposes only.
    • You may not copy, reproduce, distribute, sell, or create derivative works from the course content.
  • Workshop Images: Any images or data collected by you during an astrophotography workshop are your property. However, we reserve the right to use general images taken of the workshop in progress for promotional purposes unless you expressly object in writing prior to the event.

 

6. Limitation of Liability

 

  • Waiver of Liability (Workshops): Participation in on-site stargazing and astrophotography workshops may involve inherent risks, including but not limited to, uneven terrain, limited visibility in the dark, and trip hazards. By booking, you acknowledge these risks and agree that we are not liable for any personal injury, loss, or damage to personal property that occurs during the workshop, except where such damage is caused by our gross negligence.
  • General: To the maximum extent permitted by law, our total liability for any claim related to these Terms, the Services, or the Products is limited to the amount you paid for the specific Service or Product that is the subject of the claim. We are not liable for any indirect, incidental, or consequential damages.

 

7. Governing Law and Dispute Resolution

 

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of Portugal and the European Union.
  • Dispute Resolution: In the event of any dispute, you agree to first attempt to resolve the matter informally by contacting us at davidbernardocruz@gmail.com. If a dispute is not resolved within 30 days, you agree to mediation, or the exclusive jurisdiction of the courts in Loures, Portugal.
